Terms & Conditions For DizzleSky Ltd

 

Please read these terms and conditions carefully before purchasing a service from DizzleSky as they set out our respective rights and obligations. By using DizzleSky, you signify your consent to these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the DizzleSky. These booking conditions, in conjunction with all booking information, constitute the basis of your contract with DizzleSky Ltd, Lixton House, Loddiswell, Kingsbridge, Devon, TQ7 4EG , UK. Companies House registration number 11968755 (“DizzleSky”). A product is brought from DizzleSky by the purchaser who must be over 18 years of age (“you”). The contract between you and DizzleSky is in all circumstances to be governed by these Terms and Conditions. This contract is subject to English law and the exclusive jurisdiction of the courts of England and Wales.

 

Prices

We reserve the right to increase or decrease our public prices displayed on our website at any time before your booking is confirmed. You will be given the correct, current price of your product at the time of your booking.

 

Ethics

Ethics are of paramount importance and you are reassured that Annabel Gonifas is accredited with the EMCC (European Mentoring and Coaching Council), and works within their code of ethics framework. No claims are being made that the methods and techniques used can heal physical or mental health conditions and the session should not be a substitute for the advice and treatment of a doctor or other licensed health-care professional. The methods and techniques used are complimentary which ensures you continue to take full responsibility for your health, safety and well-being. To attend the session and / or be part of the Cook Well, Eat Well, Live Well Membership you will need to be of good enough physical and mental health.

 

Disclaimer

Websites and other published information are for educational purposes only and should not be taken as substitute for medical advice. Any decision(s) you make having received this information or following a session is wholly your own responsibility. The session(s) are completely voluntary, under your free will and at your own risk. You agree to hold DizzleSky, the venue or property owners completely harmless of all liability if you sustain any injury and assume full responsibility for any injury or injuries, physical, emotional and mental that may be sustained which are not caused by negligence or fraud (by the coach or any other party using the venue). You also understand that DizzleSky shall not be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or for any indirect or consequential loss sustained by you or any third party arising under, or in connection with any information or session received. However, nothing in this Disclaimer shall limit or exclude the liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

 

Websites

You agree that the Sites themselves, as well as all content, videos, training materials, products, services and/or other materials, made available on the Sites by DizzleSky or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by DizzleSky and are the property of DizzleSky and/or its third party providers. You agree that such Content shall include all videos, HTML/CSS, Javascript, graphics, recipes, imanges, menu plans, shopping lists, coaching tools, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms and Conditions, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Sites solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by DizzleSky. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of DizzleSky, as well as other authors who created the materials, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit or use the content of the Site or any Content, including any and all software, tools, graphics and/or sound files, for public or commercial purposes without the express written permission of DizzleSky.

1:1 Coaching

Responsibilities

DizzleSky will seek to support you to achieve your desired outcomes through facilitating coaching conversations with you. Remarkable results can be achieved where clients follow a clear plan in a committed way. However, you have sole responsibility for taking important decisions in your life. DizzleSky may assign you tasks or exercises between coaching sessions. There is no obligation for you to complete these, but not doing so may slow your progress in gaining improved quality of life or achieving desired personal outcomes. DizzleSky has no liability for any loss incurred by you, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by you, whether justified or otherwise, to achieve a material improvement in quality of life or to achieve your desired outcomes or goals.

Arrangements

The coaching schedule will be arranged between Annabel and the client. The date that the first payment takes place shall be deemed to be the start date for the service. Sessions can take place face to face (at Lixton House); or virtually via Skype, Zoom or Whatsapp (coach calls client); telephone coaching sessions (coach calls client); or other format where such is agreed. DizzleSky is responsible for ensuring that they available at agreed times. The length of each session is as agreed between DizzleSky and you before coaching sessions commence.

Confirmation and Payment

All products are non-refundable. By purchasing a service you agree to these Terms and Conditions. Once payment has been made, you will receive an email confirmation.

Payment Methods

Payment for products can be made by via the payment links sent through to you. The cost of the coaching is £199 per session based on 4 coaching sessions over 3 months. This can be made in an all-in-one payment at the start of our agreement, or in 4 monthly installments (which will include the 3 months we work together for plus a final bill). A service will only be confirmed once full payment has been received.

The coaching price includes membership to the Cook Well, Eat Well, Live Well membership for the 3 months that we work together. This will start after our first coaching session has taken place.

Amendments by you

Appointments can be rearranged at no cost within 48 hours’ notice. The session must take place within 6 months otherwise the fee for their session is forfeited. Appointments cancelled with less than 48 hours’ notice or non-attendance without notice incurs cost of full session. Further sessions cannot be booked unless fees are paid.

Amendments and cancellations by DizzleSky

In the unlikely event that any alteration is made by DizzleSky, which is deemed to be significant (for example a change of booking date), you have the right to cancel your coaching session and receive a full refund for that session on monies paid. DizzleSky accepts no legal liability and will pay no compensation. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour, actual or potential conflict of interest, or other reasons, DizzleSky can decide to terminate the service to the you early or refuse or be unable to provide further coaching sessions. In such circumstances you will be given reasonable notice of termination by DizzleSky and will be refunded for any outstanding sessions on a pro-rata basis. DizzleSky will not be held liable for any refund should we be forced to cancel or change your coaching session due to circumstances amounting in ‘force majeur’. In this contract, force majeur means such circumstances that might include, but are not limited to global pandemics, national lockdowns and localised tier systems, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, fire, technical problems, adverse weather conditions, governmental action or similar points beyond our control.

Confidentiality

Content of 1:1 coaching sessions are confidential due to client/coach privilege. There are two exceptions to this: a) Sharing with a Professional coaching supervisor for guidance and support purposes, however anything disclosed in this setting is also subject to the same strict confidentiality agreement. b) If the law requires it if there is significant danger to any individuals or parties, including yourself. A copy of the privacy policy is available on the website.

Communication & Professional Boundaries

Professional boundaries and code of conduct will be observed at all times. Reasonable contact between coaching sessions can be via WhatsApp or email.

 

Cook Well, Eat Well, Live Well Membership

Responsibilities

DizzleSky will seek to enable you to improve your kitchen confidence and kitchen management by providing menu plans, associated recipes, tutorials, videos and webinars. However, you have sole responsibility for your learning and development. DizzleSky has no liability for an loss incurred by you, whether financial or otherwise, following commencement of the DizzleSky membership, or for any perceived failure by you, whether justified or otherwise, to achieve a material improvement in your kitchen confidence, kitchen management or to achieve your desired health outcomes or goals.

Arrangements

When you register with the DizzleSky Cook Well, Eat Well, Live Well membership and/or the Sites, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from DizzleSky. You consent to receive notices electronically by way of transmitting the notice to you by email, post and through the Cook Well, Eat Well, Live Well community.

Confirmation and Payment

By purchasing the service you agree to these Terms and Conditions. Once payment has been made, you will receive an email confirmation.

Payment Methods

A monthly subscription can be made via the DizzleSky Cook Well, Eat Well, Live Well website.

Amendments by you

You can cancel your membership at any time.

Third Party Providers

DizzleSky shall not be responsible for any performance or service problems caused by any third party website or third party provider (including for example WordPress, Facebook, your web service provider service, Stripe payment services, your software and/or any updates or upgrades to that software). Any such problem shall be governed solely by the agreement between you and that provider. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Confidentiality

Content of the DizzleSky Cook Well, Eat Well, Live Well membership is confidential due to client/coach privilege. Communication & Professional Boundaries

Professional boundaries and code of conduct will be observed at all times. Reasonable contact from 9am – 5pm Monday to Friday via the DizzleSky Cook Well, Eat Well, Live Well community or email. Messages can be left outside of this time and responded to within these hours, unless time allows when they may be responded to outside of these hours.
